These Terms of Service govern your access to and use of the services provided by Shipping With Us ("Shipping With Us", "we", "us", or "our"). By creating an account, obtaining a Suite ID, accessing our website, or using any of our services, you agree to be bound by these Terms and all applicable policies.
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with these Terms, you must not use the Services. We reserve the right to modify these Terms at any time, and any updates become effective upon posting. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
We provide logistics coordination and fulfillment services, including package receiving, warehouse storage, shipment consolidation, repackaging, shipping label generation, export facilitation, and coordination with third-party carriers. We may also facilitate shipment insurance and offer additional services in the future. We are not a carrier, freight transporter, customs broker, seller of goods, or importer of record unless expressly agreed in writing. All transportation services are performed by independent third-party carriers, and their respective terms and conditions may apply to your shipment.
To use certain Services, you may be required to create an account and use an assigned Suite ID for package identification and processing. You are responsible for maintaining accurate account information and ensuring that all shipment details, declarations, values, descriptions, classifications, and destination information are complete and accurate. You are solely responsible for complying with all applicable import, export, customs, and regulatory requirements. We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, engage in fraudulent activity, maintain unpaid balances, initiate improper payment disputes, or attempt to ship prohibited goods.
You may not ship, store, or submit any item that is prohibited under applicable law, customs regulations, or carrier policies. Prohibited items include, but are not limited to, weapons, firearms, ammunition, explosives, illegal drugs, controlled substances, counterfeit or infringing goods, hazardous materials, fireworks, hazardous chemicals, live animals, stolen property, and any item restricted under import, export, customs, or carrier regulations. We reserve the right to inspect shipments and may refuse, suspend, detain, dispose of, or report any shipment suspected of containing prohibited items to the appropriate authorities, without liability to you.
You are responsible for all fees associated with the Services, including shipping charges, storage fees, insurance costs, customs duties, taxes, VAT, tariffs, carrier surcharges, return shipping fees, redelivery fees, and any related administrative costs. Payments are processed through third-party payment providers, and you authorize us to charge your selected payment method for all applicable amounts, including carrier or customs adjustments received after shipment. We may retain possession of goods until all outstanding balances have been paid in full. Goods that remain unpaid, inactive, or unclaimed for extended periods may be deemed abandoned and may be sold, recycled, disposed of, or destroyed as permitted by applicable law.
To the maximum extent permitted by law, we are not responsible for delays, service interruptions, customs holds, inspections, carrier errors, loss, damage, misdelivery, or other events arising from the actions of third-party carriers, customs authorities, or inaccurate information provided by users. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, business interruption, customs-related losses, or similar damages. In all circumstances, our total aggregate liability for any claim shall not exceed the lesser of (i) USD $100 or (ii) the total fees paid by you to us during the three months preceding the claim. Any claim relating to the Services must be submitted within ten (10) calendar days of delivery or expected delivery.
These Terms and any dispute arising from or relating to the Services shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any dispute, claim, or controversy relating to these Terms or the Services shall be resolved exclusively through binding arbitration in New York, New York. By using the Services, you agree to waive any right to participate in class actions, collective actions, or representative proceedings to the fullest extent permitted by applicable law.
